ICC Declines To Compensate Blogger/Journalist Dennis Itumbi

Back in September, blogger/ journalist Dennis Itumbi filed an application seeking compensation after the International Criminal Court (ICC) wrongly instigated his arrest over accusations that he hacked into the Hague-based Court.

ICC however rejected the application arguing that the Office of the Prosecutor did not request Kenyan authorities to arrest him and instead referred him to the Kenyan government. “The Chamber should review the Applicant’s arrest or detention only if it is first established that the arrest was attributable to or effectuated at the request of the Court or, more particularly, the Prosecution,” read a statement, on the Court’s website, signed by Judges Kuniko Ozaki, Christine Van den Wyngaert and Chile Eboe-Osuji.

The Court also declined to determine whether or not Itumbi’s arrest was illegal, maintaining that the matter should be referred to Kenya’s Judicial System when he’d inquired about the same. The Court also argued that the legality surrounding Itumbi’s arrest was not within its jurisdiction.
