{"id":207484,"date":"2024-03-13T13:52:02","date_gmt":"2024-03-13T10:52:02","guid":{"rendered":"https:\/\/www.ghafla.com\/ke\/?p=207484"},"modified":"2024-03-13T13:52:02","modified_gmt":"2024-03-13T10:52:02","slug":"in-a-copyright-lawsuit-the-court-asks-nyashinski-to-produce-the-tecno-contract","status":"publish","type":"post","link":"https:\/\/www.ghafla.co.ke\/ke\/in-a-copyright-lawsuit-the-court-asks-nyashinski-to-produce-the-tecno-contract\/","title":{"rendered":"In a copyright lawsuit, the court asks Nyashinski to produce the Tecno contract"},"content":{"rendered":"<p>Rapper and vocalist Nyamari \u2018Nyashinski\u2019 Ongegu has requested the court for additional time to provide complete contract documents regarding an ambassadorial deal he inked with Tecno Kenya Limited.<\/p>\n<p>The deal, sealed in May 2023 and purportedly worth millions of shillings, lies at the core of a Copyright infringement lawsuit filed against the popular singer by Nigerian producer Sam Eliapenda Jedidah, also known as Sam Eli.<\/p>\n<p>According to court documents obtained by Nairobi News, Sam Eli alleges that Nyashinski endorsed the Tecno device Camon 20 using the hit song \u2018Wach Wach\u2019, which he produced, as part of a brand endorsement deal with the smartphone manufacturer.<\/p>\n<p>Appearing in a virtual court session before Honourable Justice Selina Muchungi for another mention of the case, Nyashinski\u2019s defense team, Humphrey &amp; Co Advocates, requested more time to fully comply with the documents requested by the plaintiff\u2019s lawyer, James T. Makori Advocates, before setting a hearing date for the lawsuit.<\/p>\n<p>In February 2024, Sam Eli requested the court to compel Nyashinski to produce royalty reports for five songs he produced for the \u2018Lucky You\u2019 album, including \u2018Flowers\u2019, \u2018Wach Wach\u2019, \u2018Too Much\u2019, \u2018Showman\u2019, and \u2018Top Form\u2019, as well as the brand ambassadorship agreement with Tecno Kenya Limited.<\/p>\n<p>During today&#8217;s hearing, Sam Eli\u2019s legal team confirmed receiving royalty reports for only three songs and requested the remaining documents. Nyashinski\u2019s lawyers argued against producing the brand ambassadorship agreement, citing confidentiality under a non-disclosure agreement.<\/p>\n<p>Regarding the royalty reports for \u2018Showman\u2019 and \u2018Top Form\u2019, Nyashinski&#8217;s lawyers stated that they only provided reports for the songs demanded by formal request.<\/p>\n<p>However, Sam Eli\u2019s team insisted that there was a formal application for all five songs, prompting Justice Muchungi to issue fresh directions. The court directed Nyashinski\u2019s defense team to produce the royalty reports for \u2018Showman\u2019 and \u2018Top Form\u2019 songs, as well as the brand ambassadorship agreement, within 14 days.
