He further stated that the publication caused him distress.<\/p>\n<h2 data-section-id=\"5kxa4q\" data-start=\"770\" data-end=\"804\">Defence and Regulatory Findings<\/h2>\n<p data-start=\"806\" data-end=\"1136\">In her defence, Cera Imani maintained that the complainant had previously consented to be featured on the ESHE platform as a medical professional seeking visibility. She also argued that he was aware of the promotional material before it was published and that some of his professional information was already publicly accessible.<\/p>\n<p data-start=\"1138\" data-end=\"1367\">However, the ODPC determined that there was no documentary evidence demonstrating that the complainant had given express, informed, and specific consent for his name and image to be used in commercial social media advertisements.<\/p>\n<p data-start=\"1369\" data-end=\"1633\">The regulator emphasised that under the Data Protection Act, consent must be clear, purpose-specific, and verifiable. It further noted that being listed on a digital platform does not automatically amount to consent for separate marketing or advertising campaigns.<\/p>\n<h2 data-section-id=\"1vetbvt\" data-start=\"1635\" data-end=\"1671\">Compensation and Compliance Order<\/h2>\n<p data-start=\"1673\" data-end=\"1844\">The Commissioner concluded that the use of the complainant\u2019s personal data for promotional purposes without explicit consent constituted unlawful processing under the Act.<\/p>\n<p data-start=\"1846\" data-end=\"1986\">While acknowledging the Respondent\u2019s arguments, the ODPC held that the failure to prove valid consent was sufficient to establish liability.<\/p>\n<p data-start=\"1988\" data-end=\"2032\">As a result, Cera Imani has been ordered to:<\/p>\n<ul data-start=\"2034\" data-end=\"2211\">\n<li data-section-id=\"1uyv5p4\" data-start=\"2034\" data-end=\"2086\">\n<p data-start=\"2036\" data-end=\"2086\">Pay KSh50,000 in compensation to the complainant<\/p>\n<\/li>\n<li data-section-id=\"10rsiyn\" data-start=\"2087\" data-end=\"2162\">\n<p data-start=\"2089\" data-end=\"2162\">Remove his personal data from all social media platforms within 14 days<\/p>\n<\/li>\n<li data-section-id=\"jkfya0\" data-start=\"2163\" data-end=\"2211\">\n<p data-start=\"2165\" data-end=\"2211\">Provide proof of compliance to the regulator<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2213\" data-end=\"2465\" data-is-last-node=\"\" data-is-only-node=\"\">The ruling underscores the regulator\u2019s continued enforcement of Kenya\u2019s data protection laws and serves as a reminder that digital platforms and content creators must obtain clear, documented consent before using personal data for commercial promotion.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Office of the Data Protection Commissioner (ODPC) has ordered digital entrepreneur Waithera Imani \u2014 popularly known as Cera Imani and trading as ESHE Community \u2014 to pay KSh50,000 in compensation for unlawfully using a man\u2019s personal data in promotional social media content without valid consent.
