Former Nanny Appeals After Court Dismisses KSh 28 Million Lawsuit Against the Kabus

Simon Kabu and Sarah Njoki’s former nanny has taken her case to the Court of Appeal after the Employment and Labour Relations Court dismissed her lawsuit alleging sexual harassment, violation of dignity, and invasion of privacy by the estranged business couple.

The woman, identified as JK, had sued the Bonfire Adventures directors for over KSh 28 million, claiming her rights were violated during her employment. The case gained public attention in December 2024 after Simon allegedly leaked CCTV footage of an altercation between JK and Sarah. The footage fueled online speculation about the couple’s marital troubles, with JK asserting that she was unfairly labeled a “husband snatcher” and targeted on social media.

In her lawsuit, JK sought KSh 7 million for alleged sexual harassment by Sarah, another KSh 7 million for breach of confidentiality due to Simon’s release of the footage, and KSh 14 million for violation of her privacy and dignity by both parties.

However, Justice Manani ruled that JK’s lawsuit was inadmissible because her employment contract had already been terminated on October 15, 2024, following an out-of-court settlement with the Kabus. The judge stated that since there was no existing employer-employee relationship, the Employment and Labour Relations Court had no jurisdiction over the matter. JK, however, claims she was coerced into the settlement by police officers whom she believes were influenced by the Kabus.

Additionally, the judge ruled that since JK was employed by Bonfire Adventures, a registered company, rather than Simon and Sarah personally, her claims against them should have been filed in a Magistrate’s Court rather than the Employment and Labour Relations Court. Despite this, he acknowledged that the ELRC has original and unlimited jurisdiction over all labor disputes, including those within a magistrate’s jurisdiction.

JK’s lawyer, Mr. Arunda, criticized the ruling, arguing that the judge should have transferred the case instead of dismissing it entirely.

“The ELRC, as an extension of the High Court, has jurisdiction over all employment disputes. Striking out a case should always be a last resort. This is why we are dissatisfied with the decision and have already filed a notice of appeal at the Court of Appeal,” said Arunda.

JK (the woman) claims in court papers that her employment as a nanny and homeschool teacher for the Kabus’ two children in June 2024 was part of a ruse aimed at using social media to make her a scapegoat for the estranged couple’s marital problems.

JK’s case has shone a spotlight on the seemingly troubled life of the Kabus, which is a stark contrast to what the estranged duo has shown the public for years – a happy-clappy power couple using their perfect marriage to grow their company into a tourism industry behemoth.
The case has also revealed that Sarah may have narrowly dodged criminal charges for causing actual bodily harm to JK, which carries a maximum prison sentence of five years.

She is seeking Sh7 million for sexual harassment by Sarah, Sh7 million for breach of confidentiality by Simon’s release of the CCTV footage, and violation of dignity by both Simon and Sarah.

The saga, which has snowballed into an intrusive legal battle exposing secrets of the Bonfire Adventures proprietors, started on July 8, 2024, barely a month after JK was hired.
Simon and Sarah were already separated, with the latter having already moved out of their marital home in the posh Edenville gated community along Kiambu Road.

JK says in court papers that Simon had all along attributed Sarah’s absence from the home to a busy working schedule.
She says Simon and Sarah’s marriage became problematic with her thrown in the center of it despite remaining professional in her duties.
While Sarah wanted her gone and even fired her, Simon ordered her to stay a situation that intensified the couple’s marriage woe.
JK says during the back and forth between the married couple, she was at one point assaulted by Sarah who she also alleges hurled sexual innuendos at her. When she threatened to report the matter, JK says Simon urged her not to.

On August 28, 2024, Simon sent Sh250,000 to JK’s bank account, but the court papers do not indicate what the money was for. On October 15, 2024, Sarah and JK reached an out-of-court deal, and it was agreed that the money Simon had sent the latter be considered part of the settlement fee.
She notes that Sarah was also willing to give her an extra Sh100,000 to close the matter. JK now maintains that she agreed to the settlement out of duress.

“I opted for settlement because I was disappointed at how my case was being handled, the prejudice, and negative discrimination I faced at the Kiambu police station. Sarah’s case was a clear manifest of how the rich are protected by the law even if they are in the wrong,” JK says in her court filings.

The matter should have ended on October 15, 2024, after the deal was signed and everyone was told that the CCTV footage had been deleted.

But on December 4, 2024, the same video that was non-existent started trending on social media. Some social media users claimed that JK was romantically involved with Simon and that she was pregnant.
She now claims that Simon and Sarah paid some bloggers and social media users to malign her name for publicity stunts.

When JK called Simon and asked why he had leaked the video. Simon allegedly said he mistakenly sent it to the Bonfire Adventures WhatsApp group while trying to get the footage to his lawyer.

Those form the basis of JK’s next two claims for violation of privacy and reputational damage, for which she wants Sh14 million.
Simon filed a preliminary objection terming her former employee’s case as frivolous, bad in law, vexatious,s and an abuse of court.
He also wants the case to be struck out, on the grounds that, the Employment and Labour Relations court has jurisdiction to determine the suit.
The matter came up for mentioning this week before Hon. Justice Bernard Matanga who directed the parties  appear before him on 27th March 2025 for the ruling of Mr Kabu’s objection.

Kabu clarified that the woman involved in the incident was his nanny, hired through formal channels.

“The woman in the video was hired as a professional nanny by my HR and GM after I provided the job description,” he explained.

He further detailed that the altercation occurred after the nanny had been employed for about a month without any previous issues.

“The incident took place that morning, and the lady was hurt. She reported the matter to Kiambu Police Station, and a case was filed. Some people even tried to label it as attempted murder,” Kabu recounted.

Simon Kabu, the CEO of Bonfire Adventures, has treated himself to a new Range Rover. The luxury SUV is valued at approximately KSh 16 million (USD 150,000).

Kabu shared a video of his new car on Instagram, and he also wrote a heartwarming message about his journey to success.

“I used to be a matatu tout in Nairobi,” he wrote. “I would wake up at 4am every day and work until late at night. I was tired and I was broke, but I never gave up on my dreams.”

Kabu said that he started Bonfire Adventures with just KSh 50,000 (USD 500). He said that he worked hard and he never took any shortcuts.

Bonfire Adventures CEO Sarah Kabu has come out to reveal that there are still some unresolved issues between her and hubby Simon Kabu. Well, this is after their online ‘breakup’ that saw Sarah Kabu spill unknown details about her family’s private life.

We learnt about Simon Kabu having kids with other baby mamas on the side and of course about his first born daughter – Maureen from his first relationship.

The same Maureen Kabu has however become a thorn in Sarah’s flesh – which brings us to Mrs Kabu’s latest statements about her step daughter. Speaking to Mpasho, Sarah revealed her reason for exposing hubby, Simon Kabu is because he took the kids without her consent; a move that left her feeling like a crazy woman. She said;

I was trending because I was defending my children I feel they are very precious and nobody should pull such a string just because you have some rights.

Adding;

I had never imagined that someone can come pick my kids and go with them without my permission. When it happened I became like that chicken who defends her chicks.

Actually, she’s been wanting out since January 2022 – but claims Simon wasn’t having it.

The Bonfire adventures owner opened up about this during recent interview with Tina Lewis of Voice of East Africa; revealing that their marital woes began in 2003 but after 10 years of giving the marriage her best years, the solution is to put it all to an end.

Judging from the interview and what was said – I really don’t think there was any new information offered, that hasn’t been reported by bloggers yet.

However, we also can’t forget this is a personal issue between man and wife – meaning there are things, the public still don’t know about two.

Sarah hints possibility of hubby involved with Slay Queens

Some of the things fans may not be aware of include Simon Kabu’s two baby mamas who Sarah says have tried interfering with her family.

The bonfire adventures CEO even mentioned how one of the dramatic baby mamas tried forcing her child to move into Sarah home; simply because she wanted him to benefit like the two younger kids.

Simon Kabu allegedly dodging wife to avoid divorce, here’s why

With Simon and Sarah Kabu’s private affairs making rounds on social media – there are new allegations claiming Simon Kabu is avoiding his wife, Sarah who allegedly wants to divorce him.

This was revealed by a certain Facebook user identified as Wangari Ngugi who claims Simon Kabu is afraid of losing everything once divorced by Sarah Kabu. Apparently this is because Sarah is the brains behind Bonfire adventures – meaning she owns the company and Simon may end up walking empty handed after the divorce.

The lass revealed this in a post where she wrote:

Im sorry. I am choosing vayolens. Shared as received. Apparently, this is the real saga behind the Kabu’s drama. Bonfire is Sarah’s brainchild. The lady can run this business 100%.

Adding;

Simon knows he’s nothing without her….hence the Range Rover handouts.

And to make things even worse, a family member spilled more two on the breakup saying Simon Kabu apparently hid the fact that he has a 24 year old daughter from an old relationship.

With this new information (including the time he allegedly cheated) Sarah apparently wants nothing to do with her husband; but the fella is willing to fight for his marriage only because of ‘their’ successful business.

Well, not quite sure how true this is – but judging from how the couple has been moving on social media chances are that things may get ugly if not dealt with early.

Simon and Sarah Kabu, the couple that owns popular travel company Bonfire Adventures, has made yet another milestone in their lives.

A video that was posted on their YouTube page shows them unveiling a posh mansion whose location is yet to be disclosed.

Apparently, Simon was turning a year older and his wife saw it fit to  gift him with the two-storey house that has an elegant and modern design.

As the clip begins, Sarah, Simon can be seen being ushered into the house by a violin player who was standing right outside the house. Meanwhile, their son is seen playing a guitar.

A group that was on the second floor of the house sing gladly as the Kabus are handed glasses of juice before they go to admire the rest of the house.

The couple has been doing well since they established the company a few years ago. Interestingly, Simon had even worked as a tout before starting Bonfire Adventures.

In 2017, the couple made headlines after Simon surprised his wife with a brand new Range Rover as she turned a year older. Life has definitely been kind to them.
