High Court Dismisses TNA’s Bid to Expunge Former Citizen Radio Employee from Its List

The High Court in Nairobi Wednesday threw out a case filed by Uhuru Kenyatta’s TNA party seeking to have the Independent Electoral and Boundaries Commission (IEBC) compelled to allow the party to review its list of nominees for the Senate.

TNA was seeking to review its list of nominees so that Joy Adhiambo Gwendo, a former employee of Royal Media Services, could be removed from the list and replace her with Lydia Mathia. Gwendo had earlier cleared with the station after tendering her resignation for the creative assistant role she previously held ,to assume duty as one of the nominated Senators under TNA.

TNA’s national chairman Johnson Sakaja explained that the party had moved to court not to target any of its nominees but to protest reverse discrimination where one of its nominee’s names was dropped. He added, “Lydia Mathia’s name was dropped purely because of her ethnicity. Is that fair?”

IEBC reportedly picked Gwendo instead of Mathia for purposes of “regional balance”, something that Sakaja totally disagrees with saying that IEBC should not be allowed to vary the nomination list.
