Monday, Big Brother Africa – The Chase winner, Dillish Matthews, celebrated her 23^rd birthday in Namibia in a flamboyant ceremony where she was joined by her Kenyan father.

During the event, the young Kenyan-Namibian was showered with gifts, to say the least. Among the gifts she received was a brand new Volkswagen Golf GTI, specially presented by her boyfriend, Stephen.

Today we woke up to the face of witness 536 after Citizen TV Willis Raburu unwittingly exposed her. So what is next for the woman who was first to take the stand? Will she be compelled into hiding or does the ICC have laws to protect her?

Well section 68 of the Rome Statute for the international Roman court offers Protection of the victims and witnesses and their participation in the proceedings it states in part that:

-The Court shall take appropriate measures to protect the safety, physical and psychological well-being, dignity and privacy of victims and witnesses.

-The Victims and Witnesses Unit may advise the Prosecutor and the Court on appropriate protective measures, security arrangements, counseling and assistance as referred to in article 43, paragraph 6.Article 43,paragraph 6 states that ‘The Registrar shall set up a Victims and Witnesses Unit within the Registry. This Unit shall provide, in consultation with the Office of the Prosecutor, protective measures and security arrangements, counseling and other appropriate assistance for witnesses, victims who appear before the Court, and others who are at risk on account of testimony given by such witnesses. The Unit shall include staff with expertise in trauma, including trauma related to crimes of sexual violence.

-Where the disclosure of evidence or information pursuant to this Statute may lead to the grave endangerment of the security of a witness or his or her family, the Prosecutor may, for the purposes of any proceedings conducted prior to the commencement of the trial, withhold such evidence or information and instead submit a summary thereof. Such measures shall be exercised in a manner which is not prejudicial to or inconsistent with the rights of the accused and a fair and impartial trial.

 -A State may make an application for necessary measures to be taken in respect of the protection of its servants or agents and the protection of confidential or sensitive information.
 

The Kenya High Court has issued interim orders to stop an Ariel advertisement from running until the case against it is mentioned on November 11, with a view to confirming the case and issuing further orders. Justice Jaqueline Kamau however said the adverts on billboards will not be brought down on the effect of the orders.

“In the circumstances foregoing, I hereby issue interim injunctions restraining the first and second defendants by themselves, their servants, agents, employees or advertising agents from running, flighting or airing the Ariel One Wash campaign advertisements in their current form at all media houses and all forms of print or electronic media,” she said.

In her ruling on an application by Unilever Ltd’s counsel, Kamau Karuri, the judge said she had considered the company would suffer prejudice during the period she had allowed the lawyers of Procter & Gamble International Operations SA, Procter & Gamble Services Ltd and Scan Group Ltd to file their affidavits.

The Scan Group lawyer Donald Kipkorir told the court his client was not the advertising agency for the Ariel product. This was faulted by Karuri.

Unilever had applied that “the adverts falsely and by implication depict their product Omo as being grossly incapable of removing stains in one wash,” and thus sought to stop the adverts until the court determined the same.

For those of you in the dark, Unilever had sued Procter and Gamble and attached scan group to the suit as the advertiser for the former claiming thatv they were running a false ad campaign.

‘s Kenyans on Twitter are hard top fool. And they do not forgive! They attack without any remorse especially if you fumbled or made a remark on the platform that they consider less than intelligent. And this is a case in the same mould.

Kenyans on twitter have reacted to my colleague Jeff’s article on Willis Raburu not being the originator of the tweet that revealed the identity of I.C.C witness 536, a move that could potentially put her life and those of her loved ones in danger.

Citizen TV’s astute reporter/anchor Willis Raburu has just released an official statement regarding the accusations that he revealed the identity of Prosecution Witness 536 who testified in the case against Deputy President William Ruto and former radio journalist, Joshua Sang.

Here it is;

The obvious response would be, I did not do this and then I would proceed to show you how, but that will only clear my name. While I am innocent, a grave injustice has been done to the said ICC witness whom we are not even sure was the one named.

Ladies and gentlemen let us all be sober, let us as a country know that we are one people, and return to what the forefathers fought for..My fellow Kenyans as I said it would be perfect to clear my name, to show you here how much of an injustice was done to me, as my account was hacked. I have the facts and the trail of tweets but  I also have the opportunity…..

The opportunity to call for sobriety during this ICC trial, for calmness and for patriotism. Lets stop and think for one moment where we have come from as a country, and think of individuals on social media or otherwise who try to take us back to the past, try to drag us back into the arena of anguish and toil and to the stone-age  act of using someone else to pivot your success. while social media has its  place, in many cases, like this one, it has been grossly abused to perpetuate lies which beats me really….

I would hate to be that person who is sacrificed at the alter of imaginary differences so that others can be propelled to success just because social media gives us that forum.

I would like to call on bloggers and journalists all over, to understand that the right of reply is critical and that things are not always what they seem to be, no matter how sure we are we should practice the art of second guessing, for the path to truth is full of questions and the answers often lead to more questions. Journalistic practice requires of us to always verify before publishing or airing any item. I can categorically say nobody has called or asked from me, what the true position is. We call this the right of reply. I would like to state clearly that I did not name any ICC witness.

I wish to thank all of you who have practiced that benefit of doubt principle, to me the fact that you reacted so much and questioned the move is a sign of the critical role that the media still plays in shaping opinion and underscores the fact that we are a people still fragile at heart but who remain aware of  rights as embedded in the constitution. I also wish to thank all who have voiced their discomfort in the same, thank you, because you serve as an example that we are truly a democratic country that allows us to ventilate and as such i respect all that has been said in this democratic space.

I urge us to remain steadfast and focused on the path of peace.

This is not a great day for Truth Meter’s Willis Raburu.He is under siege for revealing the identity of witness 536  who was one of the Key witnesses in the Ruto-Sang Case.Before she got exposed to the public her identity was protected by a curtain in the trial chamber, her image blurred and voice modified for TV viewers in a bid to protect her identity.

According to Capital News she is one of the survivors of the grizzly arson attack at Kenya Assemblies of God church in Kiambaa on January 1, 2008.

Witness 536 recounted amidst tears of the horrific incident saying”We were getting ready to prepare our morning tea when we heard chanting and saw two groups of youth coming from behind us and the left. They were singing ‘hae ho,’ and the men told us to get the children and get into the church,” she said.One of the perpetrators Stephen Chemalang set ablaze a mattress threw it on the roof of the church wile the rest barricaded the exits with the victims bicycles.She also reported of how her friend tried to escape and got raped while another got axed!

The citizen anchor then came forward to deny exposing the witness in a series of tweets.

Kenyans on Twitter are displeased freaking pissed!Why you ask?This is because Willis Raburu whom you know and love from Citizen’s Truth Metre might have just blundered in an epic way.He is accused of revealing the identity of Witness 536 saying that :

In a rather surprisingly appalling move, Citizen TV’s Willis Raburu (he of the ‘Truth Meter’ fame) last evening tweeted the identity of the Prosecution Witness 536 who had earlier in the day testified against Deputy President William Ruto and former radio journalist Joshua Sang.

This triggered a lot of angry tweets from KOT even after Raburu had deleted the tweet as he was criticized for exposing the witness to great danger. But now it has emerged that Raburu wasn’t the originator of the tweet and that he was just reposting what he had seen on Twitter.

The identity of PW536 was initially exposed by one David K Lagat in response to KTN’s tweet;

It is after this tweet that Raburu and other KOT started posting about the witness’ identity.

At the end of the day though, what he did wasn’t right considering he has a huge following hence the impact is greatly felt.

The I.C.C is handling a very sensitive matter close to every Kenyan’s heart: the Post Election Violence. And given the gravity of the matter, they have taken measures to protect the witnesses who are giving testimonies against the president and deputy president of their country Kenya.

Then why would a journalist reveal the identity of one of the witnesses? Why would he try to put her life at risk? And the journalist in question is Willis Raburu. The Citizen TV anchor revealed the identity of witness 536 ergo putting her life and those of her family members potentially in danger.

The Citizen TV news anchor tweeted her identity against all better judgement and everyone in the office is utterly gobsmacked! We have been accused of being “yellow journalists” but even we know better than to post something as sensitive as this, let alone tweet about it.

Together, they host one of the leading comedy shows on Kenyan TV, Breaktime Show, but it seems their chemistry goes beyond the screen. It now emerges that renowned actress, Nice Ginthinji may, just may, be preggars for TV/radio host and comedian Obinna Ike.

It is common knowledge that the media should not publish the identity of minors that may be involved as victims,perpetrators participants or witnesses of an infringement, misdemeanor or felony.

The Nation Media Group found itself under heat after the conglomerate was accused of publishing photos of minors who had been arraigned in a Muranga court late last year.To make matters worse the media house refused to respond to high court orders to defend itself,this is according to Jackal News.

The media group had been charged alongside other media bigwigs such as  the Standard newspaper, Kenya Television Network, NTV, the Royal Media Services and Thika -road based media house Good News Broadcasting Services.The outraged parents to one of the minors had moved to court earlier this year complaining that their children’s rights had been desecrated.The judge then ordered the accused to defend themselves or pay up,a whopping 35 Million!Everyone complied except NMG and it is alleged that they could be forced to pay 35 million shillings!
